ORDER
The Transfer Civil Miscellaneous Petition has been filed by the petitioner/wife seeking transfer of petition for divorce filed by the respondent/husband in H.M.O.P.No.52 of 2025 from the file of Subordinate Court at Kancheepuram to the file of Subordinate Court, Tambaram.
2. The learned counsel appearing for the respondent has no objection 1/4
for allowing this transfer petition.
3. The petitioner is the wife and in her affidavit it is stated that she has got severe back pain. Hence, she finds it very difficult to undertake such a long travel to Kancheepuram from her residence at Kovur, Chennai for the purpose of attending each and every court hearings. Therefore, she filed this transfer petition with the aforesaid prayer.
4. It is settled law that in cases involving matrimonial dispute, the preference shall be given to the convenience of the petitioner/wife.
5. In the case on hand, the petitioner/wife is residing at Kovur, Chennai and she expressed her difficulty to undertake such a long travel to Kancheepuram due to her health reasons and the respondent has no objection for transfer. Hence, this Court is inclined to order the above transfer petition as prayed for.
6. Accordingly, the Transfer Civil Miscellaneous Petition is allowed 2/4
and H.M.O.P.No.52 of 2025 pending on the file of the Subordinate Court, Kancheepuram is withdrawn and transferred to the file of the Subordinate Court, Tambaram. No costs. Consequently, the connected civil miscellaneous petition is closed.
