O R D E R

The petitioner, who was arrested and remanded to judicial custody on 08.07.2025, for the offence punishable under Section 8(c) r/w 20(b)(ii)(B) of NDPS Act in Crime No.438 of 2025, registered on the file of the respondent, seeks bail.

2. The case of the prosecution is that the petitioner was found in possession of 1.100 kilograms of Ganja for the purpose of sale. Hence, the present complaint.

3. The learned counsel appearing for the petitioner seeks bail by stating that the petitioner is innocent and the respondent police had foisted a false case in view of his previous antecedents. He further submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police submitted that the petitioner is having 39 previous cases, 2/4

including one murder case, one case for the offence under Section 397 of IPC and Explosive Substances Act and two cases under NDPS. He further submitted that the petitioner is an history sheeter and if he is released on bail, there is possibility of recurrence of crime and the investigation is pending.

5. Heard both sides and perused the materials available on record.

6. Though the contraband seized from the petitioner herein is few grams above small quantity, considering the nature of previous antecedents of the petitioner and pendency of investigation, this Court is not inclined to grant bail to the petitioner at present.

7. Accordingly, this criminal original petition stands dismissed. 22.08.2025 stn 3/4
