Prayer: Criminal Original Petition has been filed under Section 482 of the Code of Criminal Procedure, directing the respondents not to harass the petitioner and its staff from running the Restaurant Business along with serving of Herbal Hookah under the name and style of M/s.KAFE LATTE. For Petitioner : Mr.Bhavik Rathore For Respondents : Mr.S.Udaya Kumar, Government Advocate (Criminal Side).
O R D E R
The petitioner-Company herein is doing the Restaurant Business, claiming that they are providing Herbal Hookah to their customers.
2. The learned counsel appearing on behalf of the petitionerCompany states that when providing Herbal Hookah to the customers of the petitioner-Restaurant is being legally permitted, the respondent-police should not harass the petitioner-Restaurant and its staff members.
3. From the above facts, this Court is of the view that whether
the materials served by the petitioner-Restaurant is permissible under law or not, it is always subject to test and verification. Therefore, a blanket order of protecting the petitioner-Restaurant and its staff members, cannot be granted.
4. In this view of the matter, the present Criminal Original Petition stands dismissed.
