This petition is filed to condone the delay of 811 days in filing the restoration petition filed by the petitioner to restore Crl.A.No.338 of 2006 which is dismissed for default.

2.It is submitted that the appeal was dismissed summarily for non prosecution without going into the merits of the case.

3. In view of the fact that the appeal being a statutory appeal and it has to be disposed on hearing the appellant, this court is inclined to condone the delay. Accordingly, the delay of 811 days in filing the restoration petition is condoned.
