ORDER

This Writ Petition has been filed seeking a direction to the respondents to consider the representation of the petitioners, in accordance with Resolution passed by the Management Council of the fourth respondent College and consequently, to issue the appointment orders with effect from 10.01.2022.

Mr.M.R.Gokulakrishnan, learned Additional Government Pleader takes notice on behalf of the respondents 1 and 5, Mr.K.Karthikeyan, learned Government Advocate takes notice on behalf of the respondents 2 and 3, and Mr.R.Bharanidharan, learned counsel takes notice on behalf of the fourth respondent. In view of the consent expressed by the learned counsel on either side, the Writ Petition is taken up for final disposal at the stage of admission itself.

3. The case of the petitioners is that they were appointed as Assistant Professors in the fourth respondent College on a consolidated basis. Though the petitioners had been working in the said College over a period ranging from 11 to 15 years, their services were not regularized. While so, the Management Council of the College, consisting of the respondents 2, 3 and 4 as members of the Committee, passed a Resolution dated 10.01.2022, wherein the Committee

recommended the regularization of lecturers who had been working for more than 10 years. Pursuant thereto, the petitioners herein made a representation, the latest being dated 24.09.2024, to the respondents 2 and 3, seeking regularization of their service in accordance with the said Resolution. However, the same has not been considered till date. Therefore, the petitioners have preferred the present Writ Petition.

4. Learned Counsel appearing for the petitioner submits that the petitioners herein were temporarily appointed as Assistant Professors in the fourth respondent College. Though they have rendered continuous service over a period ranging from 11 to 15 years, appointment orders have not been issued to them till date. The learned counsel submitted that during the year 2021, the HR & CE Department decided to regularize the staff working under various Departments throughout Tamil Nadu with specific reference to those who had been working continuously for more than five years. Pursuant thereto, the Management Council of the fourth respondent College passed a Resolution dated 10.01.2022, to regularize the temporary lecturers who had been working for more than 10 years.

The learned counsel further submits that despite several representations having been made seeking issuance of appointment orders, none of the representations have been considered till date. Therefore, the learned counsel seeks a direction to the respondents 1 to 3 to take a decision on the aforesaid Resolution, irrespective of the interim order passed by this Court.

5. Heard the learned counsel appearing for the respondents and perused the materials available on record.

Having regard to the long and continuous service rendered by the petitioners herein, spanning 11 to 15 years, and the subsequent Resolution passed by the Management Council, this Court is of the considered view that the petitioners' claim for regularization based on the said Resolution deserves immediate consideration.

Accordingly, this Court directs the fourth respondent to forward the Resolution dated 10.01.2022 to the respondents 1 to 3, if not already forwarded, within a period of two (2) weeks from the date of receipt of a copy of this order. Upon receipt of the said Resolution, the respondents 1 to 3 shall consider and pass appropriate orders on the same on merits within a period of eight (8) weeks thereafter, after affording an opportunity of hearing to the petitioners and any other interested parties. Till such decision is taken, the petitioners shall be permitted to continue in service in the fourth respondent College.

8. This Writ Petition stands disposed of with the aforesaid direction. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
