O R D E R

(Order of the Court was made by R.SURESH KUMAR, J.) Heard Mrs.Nalini Chidambaram, learned Senior Counsel for Ms.C.Uma learned counsel appearing for the Review Applicants in Rev.Appl.No.25 of 2024 and Mr.P.Paramasivadoss for Mr.S.Ganesh Kumar, learned counsel appearing for the Review Applicants in Rev.Appl.No.24 of 2024.

By these review applications, our order dated 17.07.2023 in W.A.Nos.448 of 2020 etc., batch is sought to be reviewed, where in Para 40 of the order, we have given a set of directions, the last direction reads thus: " For the purpose of clarification, we make it clear that the Firemen, who had become eligible and got promoted as Leading Firemen as on 27.03.2019 shall not, at any cost, be placed ahead of the promotees who have earned promotion before 27.03.2019." 6/9

3. Therefore, those who had become eligible and got promoted as Leading Firemen as on 27.03.2019 have already been protected and their seniority shall not be disturbed. Insofar as these applicants are concerned, they were originally enlisted as Firemen in the year 1996 and earned promotion as Leading Firemen based on their seniority in February 2019 ie., prior to the cut off date 27.03.2019.

4. Therefore, insofar as these petitioners / applicants are concerned, the position they have earned by way of promotion as Leading Firemen prior to 27.03.2019 is to be kept intact and shall not be disturbed by virtue of our direction that has been quoted herein above.

5. When that being so, there may not have been any grievance over the orders passed by this Court. Moreover, when an order passed by the Court is to be reviewed, there must be an error apparent on the face of the record. No such error is apparent on the fact of the record in the order sought to be reviewed by the learned counsel for the petitioners. Therefore, we do not find any reason to interfere with the order dated 17.07.2023 as it does not require any review.

If at all the petitioners apprehend anything at the hands of the State / Department that the orders passed by this Court dated 17.07.2023 would be wrongly interpreted and thereby the promotion / seniority earned by them would get disturbed, in such case it can only be considered as violation of the orders of this 7/9

Court dated 17.07.2023, for which the remedy lies elsewhere and not by way of review applications as have been filed now.

7. For all these reasons, both these review applications deserve to be dismissed and are accordingly dismissed. No costs. Consequently, connected miscellaneous petitions are closed.
