The petitioner is an accused in Crime No.13 of 2025 dated 08.06.2025 for the alleged offence under Sections 87, 127(2) of BNS and 5(m) r/w 6 of POCSO Act, on the file of the respondent police, seeks bail. 1/4
2. On reading the FIR, it is seen that the petitioner is a neighbouring resident of the victim girl. While she went to her grand mother's house during the holidays, this petitioner had sexually abused her, and that was reported by the child to her mother. The statement under Section 164 Cr.P.C. of the victim girl also disclosed the sexual abuse caused by this petitioner.
3. The learned Government Advocate (Crl.Side) submits that the investigation was completed and the final report filed on 29.07.2025. If the petitioner is released on bail, there is every possibility of threatening the witnesses.
4. Considering the nature of the case, this Court is not inclined to grant bail to the petitioner. Hence, this Criminal Original Petition is dismissed. The petitioner may seek bail after the examination of the victim girl and the defacto complainant.
