The petitioner herein, along with five other accused, waylaid the defacto complainant and robbed a sum of Rs.1600/- and his cell phone. 1/4

The learned counsel appearing for the petitioner submitted that the petitioner is an auto driver and the defacto complainant was only the passenger. He further contended that no such occurrence took place as alleged in the complaint.

The learned Government Advocate (Crl.Side) appearing for the respondent police opposed the grant of bail to the petitioner and submitted that the petitioner herein had taken a sum of Rs.1600/- from the pocket of the defacto complainant. He further submitted that the police have recovered a sum of Rs.1000/- from him and the balance amount is yet to be recovered. He also submitted that this petitioner and three of the co-accused are habitual offenders. and had been detained under Act 14 of Goondas Act, 1982.

4. Considering the nature of the offence and the stage of investigation, this Court is not inclined to grant bail to the petitioner. Hence, this Criminal Original Petition stands dismissed for the present.
