N.SESHASAYEE.J., The erstwhile counsel for the 1st defendant on instructions continues to make a statement that the 20th defendant is not a legally wedded wife of the 1st defendant and that his legally wedded wife is somebody else. In the meantime, the learned counsel for the plaintiff has taken out this application to bring on record the children of the 1st defendant.

2.Notice in this application has been served on the proposed respondents. No representation for them. This application is therefore allowed. 3.As and when the alleged legally wedded wife of the 1st defendant comes before this Court with necessary application, the Court will have an occasion to decide on the legal status of the 20th defendant.

4.The 20th defendant is recorded as the wife of the 1st defendant and other respondents are impleaded as heirs of the deceased 1st defendant. 1/3

N.SESHASAYEE.J., Anu 5.The plaintiff is now required to carry out amendment to the the cause title of the plaint latest by 10.02.2023.

6.So far as the marital status of the woman who is not before the Court is concerned, this Court cannot take cognizance of the same since she has not moved this Court for recognizing her status as such. 7.Upon the plaintiff carrying out the amendment to the cause title, C.S.No.510 of 2006 is directed to be posted before the learned Additional Master No.II for resumption of trial on 22.02.2023.
