PRAYER : Criminal Original Petition has been filed under Section 482 of Criminal Procedure Code, to direct the respondent to alter the FIR in Crime No.498 of 2023 on the file of the respondent police and direct to include the necessary Section such as Section 307 of IPC. ORDER

The petitioner herein seeks a direction to alter the FIR registered in Crime No.498 of 2023 on the file of the respondent police by including Section 307 of IPC.

2. The learned Government Advocate (Crl.Side) submits that originally when the F.I.R was registered against the suspected accused for the offences under Sections 341, 294(b), 324 and 506(i) of IPC and during the course of the investigation, they found that the nature of the offence and injury fall within the scope of Section 326 of IPC and therefore, charge under Section 324 of IPC has been altered to Section 326 of IPC along with other penal Sections.

3. The learned Government Advocate further submits that investigation has been completed and a final report will be filed for the offences under Sections 341, 294(b), 326 and 506(i) at the earliest.

4. Considering the said submission, this Court finds that the prayer of the petitioner herein has substantially been complied with and therefore, this petition is disposed of.
