Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus forbearing the first respondent from proceeding in any manner with reference to the notice under ref.No.E/8045/2002 dated 13.08.2003 till the conclusion of earlier proceedings initiated by the same union, that is pending before him in proceeding under Ref:E/2419/2002 dated 22.03.2002 either by consensus or by a reference under Section 36 A of the Industrial Disputes Act, 1947. The learned counsel appearing for the petitioner submits that the connected Writ Petition in W.P.No.38323 of 2002 has already been withdrawn by the Union and hence nothing survives for adjudication in this writ petition and the same may be dismissed to that extent. Hence, the learned counsel for the petitioner seeks the permission of this Court to withdraw the writ petition. She has also made an endorsement to that effect in the petition.

Recording the above submission and the endorsement made by the learned counsel appearing for the petitioner, this writ petition is dismissed as withdrawn. No costs.
