P.L.Meenakshi Sundaram v. Mrs.M.Annam And Another

Application No.5320 of 2023 in C.S.No.272 of 2021 This application has been filed seeking to implead the applicantP.L.Meenakshi Sundaram as 2nd defendant in C.S.No.272 of 2021.

2. The main grievance of the applicant is that if the 1st respondent/plaintiff is allowed to recover the entire suit amount the share payable to him will not be given and therefore, he should be impleaded as a party defendant in the suit.

3. The learned counsel appearing for the 1st respondent/plaintiff, on instructions, submitted that the plaintiff undertakes that the interest of the proposed defendant will be protected and he will part with 45% of the amount being realized. The statement of the learned counsel for the 1st respondent/plaintiff is recorded.

4. This application is closed accordingly as unnecessary in view of the undertaking given by the 1st respondent/plaintiff.
