ORDER
In this case, final report is filed complaining the offence punishable under Section 4 Tamil Nadu Open Places (Prevention of Disfigurement) Act, 1959.
2. The allegations that are made is that in a manner as to spoil the serenity of the place, a banner of the former Chief Minister was kept on 11.03.2020. It can be seen that even though the case is pending from the year 2020, the Police could not serve summons for the past 5 years. Even if Page No.1 of 3
summons is served on a future date, the same would impinge the right of speedy trial of the accused under Article 21 of the Constitution of India and accordingly, the final report and the proceedings in STC.No.586 of 2020 on the file of the Judicial Magistrate Court No.I, Ariyalur Taluk, Ariyalur stands quashed and accordingly, this Suo Motu Transfer Case stands allowed. 19.08.2025 rap electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
