O R D E R

The petitioner has filed this writ petition seeking a direction to respondents 1 and 2 to promote him to the post of Junior Engineer (Civil) Grade-I, with all other consequential benefits. 2.The case of the petitioner is that he has joined service on 21.01.1987 as Technical Assistant. The next promotional avenue available is to the post of Junior Engineer. As per the recruitment rules for the above said post, five years of service is required in the case of diploma holders and three years in the case of degree holders. The petitioner being a diploma holder is having five years of service in the said cadre. As he is entitled to get promotion to the post of Junior Engineer, he made a representation for considering promotion to the post of Junior Engineer. Finding no response, he is before this Court. 3.

Learned counsel for the third respondent would submit that after filing this petition, the petitioner was subsequently promoted as Junior Engineer Grade I on 01.02.2013. Challenging the same, the third respondent Kuppusamy has filed a writ petition in W.P. No.4020 of 2013 which is pending before this Court.

4.As the petitioner has been promoted as Junior Engineer Grade

I, after filing this petition, nothing further survives for adjudication and therefore this petition is dismissed as infructuous. No costs.
