ORDER

The final report is filed complaining the offences under Sections 279, 337, 338 Indian Penal Code, 1860 and Section 185 of the Motor Vehicles Act, 1988.

2. The allegations made by the prosecution is that on 10.07.2019, at about 7.00 p.m, the accused drove Hyundai car bearing Regn.No.TN 29 BJ 4747 in an inebriated condition dashed a two wheeler Hero Honda Shine Page No.1 of 4

bearing Regn.No.TN 73 P 1071 which was proceeding in the front, due to which, the accused and one of the witnesses sustained simple injury and the other injured witness sustained grievous injury. Upon perual of the drunken certificate, though it is true that the person has consumed liquor, the tests A to D are answered in the negative i.e., he was able to talk coherently, can appreciate the objects, able to stand, walk steadily and relax and able to recollect the past events and it is certified that though he has consumed liquor, he was not under its influence. In the said background, the charge sheet is laid in the year 2019 and it is pending for service of summons till date.

3. Considering the nature of injuries and the nature of accident, hereafter serving summons after a period of 6 years and starting the trial afresh would impinge upon the right to speedy trial of the accused under Article 21 of the Constitution of India and accordingly the the proceedings in STC.No.389 of 2020 on the file of the District Munsif cum Judicial Magistrate Court, Ranipet Taluk, Ranipet stands quashed and this Suo Motu Transfer Case stands allowed.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
