ORDER

This petition has been filed to enlarge the Petitioner on bail in the event of her arrest in connection with Crime No. 02 of 2025 now pending investigation on the file of the Respondent Police.

2. The learned counsel for the petitioner submits that the the allegation against the petitioner is that while she was working as an Assistant Manager in Tiruvannamalai District Central Cooperative Bank she conspired with other accused sanctioned gold loan to the tune of Rs.19,93,000/- in favour of borrower by accepting spurious gold jewels. Thereafter, the petitioner's property in S. No. 176/2 was attached by the cooperative bank. Now, the petitioner assured the she would not made any encumbrance over the said property and

ready to filed affidavit before the Trial Court.

3. The learned Government Advocate submits that total cheated amount is Rs.19,93,000/-, out of 22 accused, the petitioner is arrayed as A2 and the petitioner property was already attached and she is under suspension.

4. Considering the fact that the petitioner's residential property was attached and the petitioner assured that she would not make any encumbrance over the suit property but she deposited Rs.5 lakhs in the account of the bank. Accordingly, this Court is inclined to grant bail to the petitioner with conditions that the petitioner shall file an undertaking affidavit before the Trial Court that she would not make any encumbrance over the attached property in S.No. 176/2 situated at Vangakal Village.

6.Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on their appearance, within a period of fifteen days from the date of receipt of a copy of this order, before the Judicial Magistrate No.I, Thiruvannamalai, on condition that the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties each for a like sum to the satisfaction of the respondent police or the police officer who

intends to arrest or to the satisfaction of the learned Magistrate concerned and on further condition that:

[a] the petitioners and the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity. [b] the petitioner is directed to report before the respondent police on every Tuesday at 10.00 a.m for a period of four months.

[c] the petitioner shall not tamper with evidence or witness either during investigation or trial. [d] the petitioner shall not abscond either during investigation or trial.

[e] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioners in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].

[f] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 BNS.
