O R D E R

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 191(1), 191(2), 118(2), 109, 103(1) r/w Section 190 of BNS, 2023 in Crime No.195 of 2025, on the file of the respondent Police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner is employed in the OMG Pub, Mission Street, Puducherry and when there was a quarrel between the customers and the pub staff, there was an altercation between them, thereby the petitioner along with other accused assaulted the defacto complainant and his friends, due to which, one of the defacto complainant's friend namely Moshie sustained grievous injuries and later succumbed. Hence, the present complaint.

3. The learned counsel appearing for the petitioner submitted that the petitioner is innocent and he was not present at the scene of occurrence and he has been falsely implicated in this case. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for anticipatory bail to the petitioner. 2/4

The learned Public Prosecutor (Puducherry) appearing for the respondent police while opposing the anticipatory bail to the petitioner, reiterated the prosecution case and submitted that the petitioner is employed as a 'Bouncer' in the PUB and he had violently attacked the victim persons along with other accused, the CCTV camera footages indicates his overtact and one of the injured victim is still under treatment.

5. Heard both sides and perused the materials available on record.

6. Considering the nature of complaint and taking note of the fact that one of the injured victim is still under treatment, this Court is not inclined to grant anticipatory bail to the petitioner.
