A.Nos.5220 and 5221 of 2024 in O.P.No.717 of 2023 RMT.TEEKAA RAMAN,J., O.P.No.717 of 2023 is field for probate of the Will said to have been executed by Lizzie Ponnamma (Deceased).
2. After observing the formalities, the petition is now pending before the learned Master for recording of evidence. P.W.1 was examined and Exs.P1 to P9 were marked. One of the attestors by the name A.J.Solomon, who was said to have attested the subject Will, has passed away. Hence, to permit the petitioner to examine Mrs.Vasanthi John to identify the signature of the attesting witness, deceased Mr.A.J.Solomon, in the Will dated 09.02.2000 since sought to be examined as his second witness and hence this application.
3. A.No.5221 of 2024 has been filed to receive the documents hereunder as additional documents in the interest of justice. This application is allowed. Since in order to prove the truth and genuineness of the Will as contemplated under Section 68 of the Indian Evidence Act.
