Today, this Criminal Original Petition was listed under the caption "for withdrawal", on the basis of the letter dated 14.10.2020 written by the 1/4

learned counsel for the petitioner Mr.M.Sridhar, addressed to the Registrar (Criminal Side), wherein it was stated that the matter should be listed for withdrawal, as the matter has been settled between the parties.

2. This Court, vide order dated 15.10.2019 in Crl.O.P.No.26700 of 2019, granted anticipatory bail to the accused viz., Bhuvaneshwari and Sakthivel, who are the respondents 2 and 3 herein, on condition that they should deposit a sum of Rs.1,00,000/- jointly, to the credit of Crime No.1312 of 2019, now pending before the Judicial Magistrate Court, Ambattur, Chennai.

3.It is reported by the learned counsel appearing for the petitioner herein and the learned counsel for the accused as well as the learned Government Advocate (Criminal side) that the accused has complied with the aforesaid condition imposed by this Court, while granting anticipatory bail to them, by order dated 15.10.2019. It is also reported that apart from the said deposit, the accused has paid a sum of Rs.1,25,000/- by way of Demand Draft bearing No.887018, dated 6.10.2020 drawn on Indian Bank, 2/4

Ottari Branch in the name of the petitioner viz., C.Pradeep and a copy of the said demand draft has also been forwarded to Mr.M.Sridhar, learned Counsel appearing for the petitioner herein. Thus, the learned counsel appearing for both the parties jointly submitted that the matter has been amicably settled between the parties and hence, this Criminal Original Petition may be dismissed as withdrawn.

4.Recording the aforesaid statement made by the learned counsel appearing for both the parties, this Criminal Original Petition is dismissed as withdrawn, without prejudice to the case in Crime No.1312 of 2019 now pending on the file of the Judicial Magistrate Court, Ambattur, Chennai. The petitioner/De-facto complainant/C.Pradeep is permitted to withdraw the sum of Rs.1,00,000/- lying in the credit of Crime No.1312 of 2019, on furnishing proper identity and undertaking before the Judicial Magistrate Court, Ambattur.
