This Criminal Original Petition has been filed to direct the learned Judicial Magistrate No.II, Panruti, Cuddalore to expedite the trial in C.C.No.266 of 2019 within a time frame.
2. The petitioner is the de facto complainant who has given a complaint against her husband and her father-in-law on the allegation that she was ill treated by them and they caused domestic violence on her. On the basis of the allegation, a case has been registered in Cr. No.14/2019 for the offences under Section 498(A), 294(b) & 506(1) IPC. Thereafter final report was filed in C.C. No.266 of 2019 and the case has been taken on the file of Judicial Magistrate No.II, Panruti, Cuddalore during the year 2019. The grievance of the petitioner is that despite charge sheet was filed in the year 2019, the case has not been disposed.
3. On perusal of the e-Court adjudication status, it is seen that the matter has been repeatedly listed for evidence and it is not known whether the Court has served summons and summons have been served on the witnesses. Since the matter is of the year 2019, I feel it is appropriate to impress the learned Judicial Magistrate No.II, Panruti, Cuddalore to 2/4
expedite the trial and dispose the matter within a time frame.
4. Accordingly, this Criminal Original Petition is allowed and the learned Judicial Magistrate No.II, Panruti, Cuddalore is directed to complete the trial and dispose the case in C.C. No.266 of 2019 as expeditiously as possible preferably within a period of three months from the date of receipt of a copy of this order.
