This Contempt Petition has been filed to punish the contemnor for not obeying the orders passed in W.P.No.18512 of 2024 dated 11.07.2024 1/4

thereby, this Court directed the 2nd respondent to pay Earned Leave encashment for 247 days, as ordered by the 1st respondent within a period of twelve weeks from the date of receipt of a copy of this order.

2. The learned Additional Government Pleader appearing for the respondent submits that RCS direction has been confirmed by this Court as subject to the availability of funds Earned Leave encashment will be paid to the petitioner. However, this Court fixed a time for disbursal of Earned Leave encashment for 247 days within a period of twelve weeks.

3. Today, the Contemnor, who is present before this Court stated that no funds available with the 2nd respondent Society therefore, the time frame fixed by this Court cannot be complied with.

4. In view of the said submission, this Court finds that no contempt is made against the respondent. Hence, this Contempt Petition is dismissed. However, the respondent is directed to disburse the Earned Leave encashment for 247 days to the petitioner, whenever the funds are 2/4

available with the 2nd respondent Society, preferrably, within a period of six months. If the order is not complied, the petitioner is at liberty to file a fresh Contempt Petition.
