against the judgment and decree in M.H.O.P.No.116 of 2010, dated 08.06.2017, in and by which the first respondent was appointed as a guardian for the mentally ill-person K.N.Duraisamy, however, when the matter is taken up for hearing, the learned counsel appearing for the first respondent submitted that the said K.N.Duraisamy passed away.

2. In view of the above submission made by the learned counsel for the first respondent, this Court is of the view that nothing survives for adjudication in the present appeal. Accordingly, this Civil Miscellaneous Appeal is dismissed as infructuous. No costs. Consequently, connected miscellaneous petition is closed.
