ORDER

The petitioner herein before this Court challenging the onerous condition imposed on the petitioner while granting bail.

2. The learned counsel appearing for the petitioner submitted that the petitioner was granted bail on condition that to furnish two sureties and executed a bond for Rs.25,000/- each for likesum, besides one of the sureties must be blood relative. In addition to this, the trial Court has also imposed a condition to produce the original title deed of a property worth about Rs.5,00,000/- owned by the surety.

Learned counsel for the petitioner submits that the condition to produce original documents of a property worth about Rs.5,00,000/- is onerous on the petitioner while the allegation of fraud and cheating case, itself is only to a tune of Rs.29,000/-. This Court finds force in the submission made by the learned counsel for the petitioner.

4. Hence, the bail condition is modified to the effect that instead of 2/4

original documents of property worth about Rs.5,00,000/- of one of the surety, he shall furnish documents deed worth about Rs.30,000/-, or valuable security like Fixed Deposit for Rs.30,000/- and 15 days time for compliance from today is granted.
