ORDER

This writ petition has been filed by the petitioner seeking to direct the respondents to forthwith rectify / correct the indexing error committed by the 1 st

respondent in respect of Document No.99 of 2024, dated 24/01/2024, by correcting the recorded extent of the leased property from 208.963 Sq.ft to 208.963 cents and to ensure that such correction is reflected in the Encumbrance Certificate as well as relevant official records within a time frame fixed by this Court.

2.Learned counsel for the petitioner would submit that the petitioner Company owns 208.963 cents of land with 9000 sq.ft of build up area in Melthalayattimund Village, Udhagamandalam Town, Udhagamandalam Municipality, Nilgiris District and had leased out the subject property to the 3 rd respondent. The lease deed was executed and registered on 24.01.2024 in Document No.99 of 2024 on the file of the 1 st respondent. Upon obtaining the Encumbrance Certificate in respect of the subject property, it was found that the extent of the leased property had been incorrectly indexed as "208.963 Sq.ft" instead of the actual extent of "208.963 cents". Therefore, the petitioner applied for index correction through online and also made physical representations dated 04.07.2024 and 10.02.2025. Thereafter, a reminder representation dated 18.07.2025 was also made by the petitioner and the same was received by the

respondents 1 and 2 on 25.07.2025. Despite repeated requests and follow-ups, the respondents 1 and 2 failed to do the necessary corrections in the index. Hence, the present writ petition has been filed. 3.Leaned Government Advocate appearing for the respondents 1 and 2 would submit that the respondents 1 and 2 will take appropriate action to correct the extent of the subject property as "208.963 cents" in index and will ensure the same is reflected in the Encumbrance Certificate of the subject property, as expeditiously as possible.

4.Heard the learned counsel for the petitioner as well as the learned Government Advocate appearing for the respondents 1 and 2 and perused the materials available on record.

5.In view of the above submissions made by either parties, this Court directs the respondents 1 and 2 to consider the representation of the petitioner dated 18.07.2025 and rectify the indexing error by correcting the extent of the subject property as "208.963 cents" along with 9000 sq.ft build up area in the

index instead of "208.963 sq.ft" and ensure such correction is reflected in the Encumbrance Certificate and other Official records. Such exercise shall be carried out by the respondents 1 and 2, within a period of two weeks from the date of receipt of a copy of this order.
