This petition has been filed to set aside the order dated 28.06.2019 in Cr.M.P.No.299 of 2019 in C.C.No.37 of 2017 in learned Special Judge for EC Act Cases, Salem / III Additional District Judge, Salem, thereby dismissing the petition filed under Section 242(3) of Crl.P.C to defer the cross examination of P.W.4 and P.W.5.

2. Now, the learned Additional Public Prosecutor submitted that the main case itself ended in acquittal by judgment dated 11.02.2019. Therefore, the prayer sought for in this petition has become infructuous.

3. Recording the said submission made by the learned Additional Public Prosecutor, this petition is dismissed as infructuous..
