The petitioner who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 294(b), 341, 323, 324, 506(ii) of IPC r/w Section 3 of TNPPDL Act, 1992 in Crime No.202 of 2022, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner had waylaid the Government bus and abused the defacto complainant using filthy languages. When the same was questioned by the defacto complainant, who is the TNSTC bus driver, the petitioner had caused damage to the windshield of the bus worth about Rs.14,000/-. Hence, the case.

3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent and he has nothing to do with the alleged offence. He would submit that the petitioner is ready to abide by any stringent conditions imposed by this Court. Therefore, he prays for grant of bail to the petitioner.

4. The learned Additional Public Prosecutor appearing for the respondent would submit that the petitioner had waylaid the bus and caused damage to the windshield worth about Rs.14,000/-. He would submit that the petitioner is an habitual offender and there are 6 previous cases pending against him. Hence, he vehemently opposed to grant bail to the petitioner.

5.Taking into consideration the facts of the case and the submissions made by the learned counsel and also taking note of the fact that there are 6 previous cases pending against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
