Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondent to consider the tender application number 55 dated 30.09.2019 by issuing bar licence to the petitioner from 30.09.2019 to 29.09.2021 at Door No.658/3, Thiruvottiyur High Road, Tondiarpet, Chennai-600 081 attached with TASMAC Shop No.39.

O R D E R

This writ petition is filed seeking for a mandamus directing the respondent to consider the tender application dated 30.09.2019 submitted by the petitioner for running a bar attached to the TASMAC Shop No.39, situated at Door No.658/3, Thiruvottiyur High Road, Tondiarpet, Chennai-600 081.

2. After notice, the writ petition is taken up for further hearing, today, pursuant to few adjournments at the request of the learned standing counsel for the respondent.

3. Today, it is represented by the learned standing counsel for the respondent that the petitioner is not the highest bidder and on the other hand, one Sivakumar is the highest bidder and therefore, the bar licence is to be issued in favour of such person only.

4. When such being the case, the petitioner has to work out his remedy against the issuance of licence in favour of the third party, if he has any valid and legal ground to challenge such issuance of licence. Accordingly, this Writ Petition is disposed of, as no further order is necessary, however, by granting liberty to the petitioner to work his remedy in the manner known to law against the issuance of licence in favour of the third party, provided if the petitioner is having any valid and legal ground to make such challenge. The respondent is directed to communicate the petitioner about the rejection of his tender application. No costs.
