The petitioner is the resident of Visakapattinam, Andrapradesh. He was found in possession of 20 Kgs of Ganja by the respondent police on 04.03.2021, while he was transporting from Andra Pradesh to Tamil Nadu.

2. When he sough for bail, this Court considering the objections made by the learned Government Advocate (Crl.Side) that the petitioner have no routes in this State and he who hails from Viskapattinam, if granted bail he may abscond. However, considering the period of incarceration, bail was granted on condition that he should execute a bond for a sum of Rs.1,00,000/- with two sureties and report before the trial Court on every first working day of the English Calender month. This bail order was passed by this Court on 20.04.2022. Now the petition is filed to modify the condition stating that if the condition of executing a bond for Rs.1,00,000/- was not modified, it will cause hardships.

3. The similar request was made earlier in Crl.M.P. No.5378 of 2023 and the same was considered by this Court and rejected on the ground that the petitioner being non-native of the State and considering the gravity of the offence, the condition imposed is not disproportionate and the request was dismissed on 21.04.2023. rkp reasons stated by this Court while dismissing the earlier petition on 21.04.2023 in Crl.M.P. No.5378 of 2023, still holds good.
