These Miscellaneous Petitions are filed to set aside the common Judgment dated 18.10.2019, which was dismissed for non prosecution and to restore the Second Appeals Nos.1473 and 1474 of 2011 to the file.

2.Heard the learned counsel for the petitioner.

3. The learned counsel for the respondents has no objection for allowing these petitions.

4. Having regard to the reasons stated in the affidavits filed in support of these petitions and this Court being satisfied with the same, these MPs are allowed as prayed for and both Second Appeals are restored to file.

5. Since both Second Appeals have been restored, CMP 19386 & 19390 of 2019, which were earlier closed have been restored 1/3

to file. Registry is directed to list those petitions also along with both the Second Appeals for hearing on 2.12.2019.
