C.M.P.Nos.27050, 27058 & 27060 of 2019 in A.S.No.326 of 2011 S.M.SUBRAMANIAM.,J These petitions are filed to condone the delay of 2549 days in filing the petition to set aside the abatement; to set aside the abatement caused by the death of the appellant Ramasamy and to bring on record the legal representatives of the first and second appellant in the first appeal.

2.This Court is satisfied with the reasons stated in the supporting affidavit. The petition in C.M.P.No.27050 of 2019 to condone the delay of 2549 days in filing the petition to set aside the abatement is ordered and the delay is condoned. The abatement caused due to the death of the first appellant is set aside and C.M.P.No.27058 of 2019 is allowed. Proposed appellants are ordered to be brought on record as legal representatives of the deceased first and second appellant in the Appeal and the petition in C.M.P.No.27060 of 2019 is allowed.
