ORDER
This Writ Petition has been filed, seeking a direction to the 2nd respondent to consider the petitioner's request for Transfer application, dated 11.07.2025 and the subsequent representation of the petitioner, dated
06.08.2025 and accommodate the petitioner as an Assistant Engineer (Electrical) in Salem Electricity Distribution Circle in the existing or in the arising vacancy, if otherwise qualified as per the Request Transfer Rules.
2. Mr.K.Rajkumar, learned Standing Counsel takes notice for the Respondents.
3. By consent, this Writ Petition is taken up for final disposal today at the admission stage itself.
4. The petitioner is working as an Assistant Engineer in the respondents Corporation. The grievance of the petitioner is that his request for transfer application dated 11.07.2025 and the subsequent representation dated 06.08.2025, have not been considered by the Respondents. Hence, this Writ Petition.
5. When the mater is taken up for hearing, the learned Standing counsel appearing for the Respondents would submit that as Disciplinary Proceedings are pending against him and as per Rule 11(vii) and Guidelines of the TANGEDCO, the request for transfer cannot be
considered.
6. Though the Rules of TANGEDCO says that the petition for request of transfer cannot be considered when Disciplinary proceedings are pending, citing the same, the respondents can not keep the representation of the petitioner pending without passing any orders.
7. In view of the above, without going into the merits of the case, this Court directs the respondents to consider the representation of the petitioner dated 11.07.2025 and 06.08.2025 and pass appropriate orders on its own merits and in accordance with law within a period of six weeks from the date of receipt of a copy of this order.
8. With the above direction, this Writ Petition stands disposed of. No costs.
