ORDER

(Order of the Court was made by R.Suresh Kumar J.) The prayer sought for in this writ petition is to direct the respondents to consider the petitioner's representations dated 19.09.2022 and consequently, direct the second respondent to evict the respondent Nos.3 to 5 from the Government land in S.No.673/6, situated at Ramachandrapuram, Anikkadavu Village, Udumalpet Taluk, Tiruppur District within in a time frame fixed by this Court.

2.In order to take action against the private respondents herein who allegedly encroached upon the Government land at S.No.673/6, situated at Ramachandrapuram, Anikkadavu Village, Udumalpet Taluk, Tiruppur District, the petitioner has given a representation to the first respondent, District

Collector on 19.09.2022 and since no action has been taken by the Revenue Authorities, especially, the District Collector, the petitioner has moved the present writ petition.

3.Heard the learned counsel for the petitioner and the learned Special Government Pleader for the official respondents. In view of the order that is going to be passed in the writ petition, notice to the private respondents is hereby dispensed with.

4.That the petitioner has given the said representation to take action against the private respondents as they have been allegedly in occupation of the Government land. In this regard, action has to be taken only by the Revenue Authorities. Therefore, we feel that a direction can be given to the Revenue Authorities to take action on the said representation and to pass orders thereon on merits and in accordance with law. In the result, the following order is passed in the writ petition that there shall be a direction to the respondents 1 and 2 to consider the representation of the petitioner dated 19.09.2022 and pass

orders on merits and in accordance with law, wherein, if they ultimately find that any encroachment is made by the private respondents against whom any action is to be taken, the Revenue Authorities shall give proper notice to the private respondents under the provisions of the Land Encroachment Act and accordingly act upon.
