ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offence under Section 132, 351(2), 303(2) of BNS Act, 2023 and Section 21(4) of Mines and Minerals (Development and Regulation) Act, 1957 in Crime No.231 of 2025, on the file of the respondent Police, seeks anticipatory bail.

2. The allegation against the petitioner is that based on the secret information regarding mining sand from Thenpennai River, the respondent police went to the place of occurrence and found that the petitioner along with others were illegally transported 4 units of sand from Thenpennai River in Lorry without any valid permit and the respondent police seized the lorry. Hence the case.

2. The learned counsel for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case. He further submitted that he is ready to co-operate for investigation. Hence, he prays to grant anticipatory bail to the petitioner.

3. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and reported that totally there are three accused and that the petitioner is ranked as A3. He further submitted that investigation in this case is still pending and no previous bad antecedents registered against him. However, he oppose to grant anticipatory bail to the petitioner.

4. Considering the above facts and circumstances of the case, the nature of allegation and the fact that investigation of this case is pending, and also the fact that the petitioner has illegally transported river which causing 2/4

damage to the ecology and water body, this Court is not inclined to grant anticipatory bail to the petitioner.
