ORDER
The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 296(b), 115(2), 351(2) of BNS, 2023, and Section 4 of the Tamil Nadu Prohibition of Harassment of Women Act, 2002, in Crime No.87 of 2025 on the file of the respondent police, seek anticipatory bail. The FIR is registered against these four petitioners.
2. The learned Government Advocate appearing for the respondent states that investigation in this case is completed and final report is filed against the petitioners 2, 3 and 4. It is also brought to the notice of this Court that there is a counter compliant given by the third petitioner herein against Sampangi Reddy and others, which is registered in Crime No.88 of 2025 on the same day.

Considering the fact that it is the case and case-in-counter between two families regarding the property dispute and investigation has already been completed, this Court is of the view that custodial interrogation of the petitioners are not required. Hence, this Court is inclined to grant anticipatory 2/6
bail to the petitioners 2, 3 and 4 with certain conditions. Insofar as the first petitioner is concerned, the anticipatory bail petition stands dismissed.

Accordingly, the petitioners 2, 3 and 4 are ordered to be released on bail in the event of arrest or on their appearance, within a period of 10 (ten) days from the date of receipt of a copy of this order, before the learned Judicial Magistrate, Denkanikottai, on condition that the petitioners shall execute a separate bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that:
(a) If the petitioners failed to surrender before the concerned Magistrate, within a period of 10 days from the date of receipt of a copy of this order, this order shall stand automatically cancelled;
[b] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of 3/6
Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity; [c] the petitioners 2, 3 and 4 shall report before the concerned Court for trial on all hearing dates; [d] On breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to pass appropriate orders against the petitioners in accordance with law as if the aforementioned conditions have been imposed and the petitioners released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283];
[e] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S.
