(Order of the Court was made by M.M.SUNDRESH,J) Seeking a direction to the first respondent to grant three months leave to the convict Dasaraj, son of Sindariyappa, Life Convict in C.No.16712, now confined in Central Prison, Vellore, this petition has been filed by the grand daughter of the convict.

2.When the matter is taken up for hearing, the learned Additional Public Prosecutor seeks further time.

3. The facts governing are not in dispute. In fact, we have recorded the facts in our earlier order, which has also been incorporated in the impugned order. Therefore, we do not wish to say anything more.

4. Thus, considering the facts governing, while granting time for the learned Additional Public Prosecutor for filing counter affidavit, we direct the respondents to grant ordinary leave for a period of six weeks to the convict starting from 05.11.2019 to 17.12.2019.The convict shall be released at 10.00 a.m. on 05.11.2019 and shall return back to prison at 5.00 p.m. on 1/3

17.12.2019.

5. In the meanwhile, the respondents is directed to file the counter affidavit in the main Habeas Corpus Petition. 6.In view of the above, this miscellaneous petition is disposed of.
