(2)WP.No.30250/2025 is filed for a mandamus directing the 1 st respondent to
consider the petitioner's representation dated 13.12.2024, on the basis of the recommendations of the 3 rd respondent dated 26.12.2024, 12.03.2205, 06.06.2025 and 11.07.2025 and to extend the lease period by 173 days for operating ferry service and toll collection so as to compensate the loss caused due to suspension of ferry service for 83 days and reduction of toll charges for the two wheelers from Rs.40/- to Rs.30/-. (3)Heard both sides and perused the records. With the consent of both the learned counsels, the main writ petitions are disposed by this common order. (4)The petitioner participated in the auction conducted on 22.11.2022, for operating ferry service between Pannavadi Village and Nagamarai Village and for toll collection.
The petitioner was the successful bidder and accordingly, the lease right for toll collection was granted to the petitioner for a period of three years from 11.12.2022 to 14.09.2025. The petitioner states that while so, the ferry service was suspended by the authorities for 83 days due to low and heavy water flow in the river. The petitioner further states that on the representation of the villagers, the toll charges for the two wheelers was reduced from Rs.40/- to Rs.30/- by the authorities.
petitioner states that because of suspension of the ferry service and the reduction of toll charges, the petitioner suffered heavy losses and therefore, the petitioner submitted a representation to the respondents on 12.07.2025, requesting the authorities to extend the period of lease by 173 days. The petitioner further states that based on the representation of the petitioner dated 12.07.2025, the 3 rd respondent recommended the case of the petitioner for extension of lease period by 173 days to the 1 st respondent, on four occasions, i.e., on 26.12.2024, 12.03.2205, 06.06.2025 and 11.07.2025. However, the same was not considered by the 1 st respondent.
(5)The petitioner, therefore, filed WP.No.30250/2025 for a direction to the 1 st respondent to consider the petitioner's representation dated 13.12.2024, and to extend the lease period by 173 days. The petitioner further states that pending the aforesaid writ petition, the 4 th respondent issued the auction notice and therefore, the petitioner filed the present writ petition for the aforesaid relief.
(6)At the time of hearing, the learned Government Advocate, appearing for the respondents 3 and 4, submitted that on 19.08.2025, the impugned auction
notice dated 12.08.2025, was withdrawn and hence, nothing survived for adjudication in WP.No.31719/2025. The learned Government Advocate, also produced a copy of the proceedings dated 19.08.2025, before this Court. (7)Recording the submission of the learned Government Advocate appearing for the respondents 3 and 4, WP.No.31719/2025 is dismissed as infructuous. No costs. Consequently, the connected miscellaneous petitions are closed. (8)Insofar as WP.No.30250/2025 is concerned, under the facts and circumstances of the case, this Court is of the view that the same can be disposed of by issuing appropriate directions to the 1 st respondent. It is seen that the petitioner's representation dated 13.12.2024, is pending for more than eight months with the 1 st respondent, without any orders being passed till date. Hence, a direction is issued to the 1 st respondent to consider and pass orders on the petitioner's representation dated 13.12.2024, on merits and in accordance with law, within a period of two weeks from the date of receipt of a copy of this order.
(9)WP.No.30250/2025 is disposed of accordingly. No costs.
