This writ petition has been filed for the issue of writ of mandamus directing the 1st respondent to dispose of the appeal filed by the petitioner on 20.10.2023 along with condonation of delay petition within the time frame fixed by this Court.
2.Heard the learned counsel for the petitioner and the learned Special Government Pleader for respondents 1 & 2. 3.The grievance of the petitioner is that she was working as Secondary Grade Teacher in the 3rd respondent School and she was relieved from service without any notice by letter dated 13.08.2021. Aggrieved by the same, the petitioner filed appeal before the 2nd respondent under Section 23 of the Tamil Nadu Recognized Private 2/5
Schools (Regulation) Act, 1973. The appeal filed by the petitioner was rejected by the 2nd respondent by proceedings dated 28.08.2023. Aggrieved by the same, the petitioner filed second appeal before the 1st respondent under Section 41 of the Act with a delay of 22 days. The grievance of the petitioner is that till date the appeal has not been admitted by the 1st respondent and therefore, the present writ petition has been filed before this Court.
4.Taking into consideration the facts and circumstances of the case and the limited relief sought for by the petitioner, there shall be a direction to the 1st respondent to deal with the appeal filed by the petitioner on merits after affording opportunity to the respondents 3 to 6 and final orders shall be passed within a period of eight (8) weeks from the date of receipt of a copy of this order.
5.In the result, this Writ Petition is disposed of with the above directions. No costs.
