ORDER
The allegation in this case is that on 22.03.2003, when the public servant visited the spot at Nungambakkam, Kamarajapuram within the Chennai Corporation limits for serving notice of eviction on the encroachments, it is alleged that two accused in this case abused the public servant in filthy language and also threatened him and hence, the case was registered for the alleged offences under Sections 341, 354 and 506(ii) of Indian Penal Code.

2. After filing a final report, summons was served only on the first accused and the case against the second accused was split up. After full trial, the case against the first accused ended in acquittal. The very identity of the second accused remains in question. Till date, warrant is pending. Considering the nature of allegations and the fact that the case is pending for the past 22 years and that no useful purpose will be served by keeping the matter pending and further, it will be violative of the right to speedy trial on the part of the second accused, whose identity is also doubtful, I am of the view that the case in C.C.No. 5 of 2023 on the file of the Additional Mahila Court, Egmore Taluk, Chennai shall stands quashed.
3. Accordingly, this Suo Motu Transfer Case stands allowed. 20.08.2025 nsl electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned. 2/3
