ORDER
This writ petition has been filed by the petitioner seeking to direct the 1 st respondent to pass an award and grant a just compensation to the land acquired
for the purpose of expansion of Airport, to an extent of 1.82 Hectares, Comprised in Survey No. 379/1, situated at Manapakkam Village, Sriperumbudur Taluk, Kancheepuram District, under the Provisions of Tamil Nadu Acquisition of Land for Industrial Purposes Act, 1997, after following the method contemplated under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, for determination of compensation.
2.Learned counsel for the petitioner would submit that the 3 rd respondent acquired the petitioner's land to an extent of 1.87 hectares comprised in S.Nos.379/1 & 379/2 situated at Manapakkam Village, Sriperumbudur Taluk, Kancheepuram District, for the purpose of expansion of Chennai Airport. Despite the acquisition, the 1 st respondent has not awarded compensation. The petitioner made a detailed representation dated 18.10.2023, requesting the respondents to pass award and grant a just compensation for the acquired land. However, till date the respondents neither considered the representation of the petitioner nor passed an award determining the compensation. Hence, the present writ petition has been filed.
3.Learned Additional Government Pleader appearing for the respondents 1 to 3 after getting instruction would submit that, in the present case, the official respondents are supposed to pass award and he requested to grant eight weeks time for passing the award.
4.In reply, learned counsel for the petitioner requested this Court to direct the 1 st respondent to issue notice to the petitioner before passing the award, so that the petitioner can submit the market value and guideline values of the property acquired, which would help the respondents to award just compensation.
5.Heard the learned counsel for the petitioner and the learned Additional Government Pleader appearing for the respondents1 to 3. 6.Considering the submissions made by either parties, this Court directs the 1 st respondent to pass award and grant a just compensation to the land acquired from the petitioner to a extent of of 1.82 Hectares, Comprised in
Survey No. 379/1, situated at Manapakkam Village, Sriperumbudur Taluk, Kancheepuram District, under the Provisions of Tamil Nadu Acquisition of Land for Industrial Purposes Act, 1997, within a period of eight weeks from the date of receipt of a copy of this order. Further, the 1 st respondent is also directed to issue notice and grant personal hearing opportunity to the petitioner before passing the award so that the petitioner can appear in person and produce the documentary evidence with regard to the market value and guideline value of the property acquired.
