ORDER

This case is for the alleged offences under Sections 279 and 337 of Indian Penal Code, 1860. The occurrence was on 28.07.2009 at about 4:30 AM. The case is pending for the past 16 years. It is stated that the very identity of the accused is in question and no such person is available at the address. In spite of best efforts by the police, the accused could not be traced. 1/3

2. Considering the nature of allegations, even if in future the warrant is executed/summons is served, the continuation of the proceedings will impinge upon the right to speedy trial of the accused.

3. In view thereof, the C.C.No.100086 of 2017 on the file of the District Munsif cum Judicial Magistrate, Vazhapadi Taluk, Salem shall stands quashed and accordingly, this Suo Motu Transfer Case stands allowed. 20.08.2025 nsl electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned. 2/3
