ORDER
The allegation in this case is that, on 02.12.2011 at about 10:45 AM, when the defacto complainant came out of the bank with his bag containing a cash of Rs.1,56,000/- and passbook and the other things, the accused had willfully dropped Rs.10/-note and diverted the attention of the defacto complainant by asking him whether the Rs.10/- note belongs to him and within a flash of second, decamped with the bag. Thereafter, when the accused was arrested, a sum of Rs.6000/- alone was recovered and the same was paid out to the defacto complainant, as the money belong to the Cooperative Society.

Subsequently, even during the course of the investigation, the accused remained untraceable and only absconding chargesheet was filed and was taken on file as C.C.No 43 of 2012. Even though summon was issued, it was not served. Thereafter, warrant was also issued and could not be executed for the past 13 years. The respondent police submit that even in spite of their best attempts, they could not find any such person as Lakshmanan and absolutely his whereabouts are not known. Even at the time of remand, it is seen that the address is given in a very vague manner, as Milk Colony, Ramji Nagar, Trichy. Therefore, no useful purpose will be served in keeping the matter pending, as already 14 years passed by from the date of incident. 3.
Accordingly C.C.No.100068 of 2017 on the file of the learned District Munsif cum Judicial Magistrate, Vazhapadi Taluk, Salem is quashed and this Suo Motu Transfer Case stands allowed. 20.08.2025 veda electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
