ORDER

The allegations in this case is that, on 17.11.2013, when the deceased had purchased a new Swift Desire care in Chennai and was travelling back, the accused was driving a lorry bearing registration number TN 40B 9299 in a rash and negligent manner from the opposite direction and dashed against the Swift Desire car. On account of which, the deceased sustained injuries and died.

Originally, the address of the accused is shown as Paigamandu, Aada M.Palada, Ooty. Though the accused was appearing in the case for some time, from the year 2023, he has stopped appearing in the case. It is stated that the victim family had also filed Claim Petition and award has already been made for compensation. The warrant remains unexecuted, as the whereabouts of the accused is totally not known.

Considering the nature of accident and the fact that the accident said to happened in the year 2013 and 12 years have gone by now, on useful purpose will be served, by continuing the case. Accordingly, C.C.No.100113 of 2017 on the file of the learned District Munsif cum Judicial Magistrate, Vazhapadi Taluk, Salem is quashed and this Suo motu Transfer case is allowed.

The Trial Court shall take note of the order and accordingly pass consequential orders, by formulating / classifying the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider whether any consequential orders such as disposal of properties should be passed and if necessary shall pass such consequential order as may be necessary.
