The petitioner herein is the tenant under the 2nd respondent was called for enquiry on the complaint given by the 2nd respondent alleging harassment by the Police. Hence, the present petition is filed for a direction not to harass except due process of law.
2. The learned Government Advocate (Criminal Side) appearing on behalf of the 1st respondent submits that as per the complaint given by the landlord, the petitioner was called for enquiry and after enquiry, having found that it is a landlord-tenant dispute and a Suit for eviction is pending. That apart another Suit filed by the petitioner herein is pending for not to evict them without due process of law, hence, the Police have closed the complaint, since the petitioner has already approached the Civil Court for the very same relief. In fact the Police have also closed the complaint given by the 2nd respondent. Hence, nothing survives in this Criminal Original Petition and stands dismissed.
