The petitioner/accused in Crime No.457 registered for an offence under Sections 4(1)(aaa), 4(1)h and 4(1-A)ii of TN Prohibition Act, seeks anticipatory bail.
2.The earlier anticipatory application in Crl.OP.No.22662 of 2023, had been dismissed by an order of Court dated 4.10.2023. There is effectively no change in circumstances.
3.It is seen that the allegation as against the petitioner is that, the respondent had intercepted a Gray colourTATA VENTURE CAR and on inspection, it was found that varied liquor bottles of Karnataka origin totally 1248 pockets were found. They were kept in 22 cartons, 4 cartons, 10 separate cartons and 8 further cartons. Taking into account large seizure of Karnataka origin liquor, even on the earlier occasion, the anticipatory bail had been dismissed. The status is still the sane. There is no change in circumstances. Respondents also have probably taken a decision not to take the petitioner into custody and the petitioner taken a decision to continuously file anticipatory bail applications. The Court shall also continuously dismissed the anticipatory bail applications.
4. Accordingly, this criminal original petition stands dismissed.
