The petitioner who was arrested and remanded to judicial custody on 27.11.2022 for the offences registered under Sections 5(1), 5(r) r/w 6 of POCSO Act, 2012 and Sections 450, 376(1), 354(B), 307 of I.P.C in Crime No.10 of 2022, on the file of the respondent Police, seeks bail.
2. In the earlier application in Crl.O.P.No.24127 of 2023 dated 18.10.2023 it had been observed that the chief examination and cross examination of the victim girl should be completed. It is stated that only the chief examination has been completed. A direction is given to the learned Judicial Magistrate to proceed further with the trial in Spl.S.C.No.49 of 2023 before the Special Court for Exclusive Trial of cases under POSCO Act, Chengalpet.
3. The learned counsel appearing for the accused should also realise that without completion of the cross examination the application for bail cannot be considered. If application under Section 311 or cross examination is not done then bail petition would be dismissed. 1/3
4.With the above observations, this Criminal Original petition stands dismissed.
