Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the respondents to issue online patta for the lands in Survey Nos. 55/24, 55/25 and 55/21, measuring an extent 0.29 acres situated at Neelankarai Village, Saidapet Taluk, Chennai, within a stipulated time frame as fixed by this Court. 1/5

O R D E R

The petitioner herein seeks a direction to the respondents to issue online patta for the land situated in S.Nos.55/24, 55/25 and 55/21 with an extent of 0.29 acres, at Neelankarai Village, Saidapet Taluk, Chennai District.

2. It is the case of the petitioner that the above mentioned property was purchased by the petitioner's mother Girija under a registered sale deed dated 17.07.1982 and she died in the year 2004. The petitioner and his brother K.M.K.Arjun, are the legal heirs of deceased Girija. The petitioner applied for online patta transfer on 30.08.2024 and his application was rejected with the message "site cannot be reached". The petitioner subsequently sent a legal notice to the respondent on 25.07.2024 seeking issuance of patta in the name of the petitioner and his brother and the same has not been considered. Hence, the petitioner is before this Court. 2/5

3. This Court is not inclined to issue any direction to the respondents to consider the legal notice issued by the petitioner. However, it is open to the petitioner to submit a fresh representation before the second respondent seeking issuance of patta in his name and his brother in his capacity as legal heir of deceased Girirja by enclosing all necessary documents. If any such representation is made by the petitioner, the same shall be considered by the second respondent and final order shall be passed, on its own merits, within a period of six weeks from the date of receipt of such representation.

4. With the above direction, this Writ Petition is disposed of. No costs.
