The plaintiffs in O.S.No.2057 of 2019, which is pending on the file of the first Additional City Civil Court, Chennai, have presented this application for transfer of the said suit to the file of this Court.

2. In the affidavit in support of this application, it is stated that the suit was filed challenging the earlier order of this Court dated 16.10.2006 in C.S.No.990 of 2001. Therefore, it is stated that the suit cannot be decided by the first Additional City Civil Court, Chennai.

3. Learned counsel for the first defendant submits that he has no objection to this application being allowed.

4. The second defendant remained ex parte in the suit. The third defendant is the jurisdictional Sub-Registrar. 1/2

5. In the above circumstances, this application is liable to be and is hereby allowed as prayed for. Consequently, the Registry is directed to renumber and list the suit upon receipt from the first Additional City Civil Court, Chennai. Consequently, nothing survives for adjudication in A.No.5704 of 2022 and the same is closed.
