A.No.5325 of 2022 A.No.5325 of 2022 in C.S.No.256 of 2018 C.V.KARTHIKEYAN , J., This application has been filed by a third party to the suit consequent to the applicants herein, having deposited a sum of Rs.4,35,27,548/-, which, the Joint Registrar (Original Side) by certificate dated 07.11.2022, has affirmed is lying in to the credit of the suit. The said sum had been deposited with the Court hoping they would be able to purchase some of the properties which was brought to sale by the Advocate Commissioner, learned Senior Counsel Mr.M.K.Kabir. The sale did not fructify and therefore, return of the said amount is sought.
2. Heard all the learned counsels for the plaintiff and the defendants. They have not raised any objections.
3. At any rate, the amount is lying to the credit to the suit and there is no possibility of the sale ever going through.
4. Impleading applications have also been filed by the Revenue Divisional Officer, which applications are also pending.
