ORDER
In this case, the allegation is that on 11.03.2020 at about 12:30 hours, when the injured witness was travelling on a two-wheeler, the accused rode his two-wheeler bearing number TN 48 AS 3233 in a rash and negligent manner and caused injuries to the injured witness and as such, a case was registered for the offences under Sections 279 and 337 of Indian Penal Code, 1860 in Crime No. 413 of 2020 on 24.06.2020. Thereafter, the charge sheet was filed on 05.01.2021. Even though summons was ordered to the accused for almost 4 1/3
years and 6 months now, the summons remains unserved on the accused.
2. Considering the nature of allegations, even if the summons is served on a future date, the same would only impinge upon the right to speedy trial guaranteed to the accused and as such, no useful purpose will be served in keeping this case pending.
3. Accordingly, the proceedings in S.T.C.No. 704 of 2022 on the file of the Judicial Magistrate Court No. II, Ariyalur Taluk, Ariyalur shall stand quashed and this Suo Motu Transfer Case stands allowed. 20.08.2025 nsl electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned. 2/3
