ORDER

The allegation in this case is that on 24.01.2021, the accused was found to be in possession of three bottles of liquor of 180 ml each.

Considering the fact that the same is within the consumable limit of an individual, I am of the view that prima facie the offence under Section 4(1)(K) of Tamil Nadu Prohibition Act, 1937 is not made out. It can also be seen that there is no other previous or subsequent case against the accused and 1/3

as such, the allegation that he has kept the same for sale is also prima facie not made out.

3. In view thereof, no useful purpose will be served in keeping the case pending. Accordingly, the proceedings in S.T.C.No.533 of 2021 on the file of the Judicial Magistrate II, Jayamkondam Taluk, Ariyalur shall stand quashed and this Suo Motu Transfer Case stands allowed. 20.08.2025 nsl electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
